Artikel 124: Autonomy; co-governance

Artikel 124
  1. The powers of provinces and municipalities to regulate and administer their own internal affairs shall be delegated to their administrative organs.
  2. Provincial and municipal administrative organs may be required by or pursuant to Act of Parliament to provide regulation and administration.

Explanation

Please note: Only the Dutch-language version of the Constitution has legal effect.

Provinces and municipalities are administrative levels with independent powers. They are authorized to undertake tasks related to the administration and policy of the province or municipality, unless this policy conflicts with statutory rules. Additionally, a law may stipulate that, by order of the bodies mentioned in that law, provincial and municipal administrations must cooperate in regulation and administration.

The organization of the administration of provinces and municipalities is laid down in the law: the Provincial Act and the Municipal Act.
